Summary Judgment to Schwab & Gasparini Client, Yonkers Raceway & Casino

On March 29, 2011, Schwab & Gasparini successfully obtained summary judgment for its client, the Yonkers City Raceway & Casino in Frederick v. Empire City Casino and Yonkers Raceway. The plaintiff had alleged that she tripped and fell on the uneven base of a stanchion which she claimed was placed dangerously close to a bank of slot machines within the Casino. She also claimed that the area was dimly lit.

The Court was presented with a Casino video which depicted that the stanchions were approximately eight feet from the bank of slot machines upon which the plaintiff fell, and concluded there was no proof that they were "unstable" as the plaintiff contended within the lawsuit.
