SG Obtains Dismissal in Potential Seven Figure Negligence Claim

SG obtained summary judgment on a case with seven figure exposure in July 2023.

Plaintiff commenced an action to recover damages for significant personal injuries when she fell outside of a coffee shop in Westchester County, New York.  Through discovery, SG established that the area in question had recently been constructed, that the poured concrete surface was constructed in accordance with approved building codes, and that the area was free of any defects.  Plaintiff had pursued an alternative theory that the location was dangerous, namely that when it rained the surface became unreasonably slippery.  However, SG Partner Lou Gasparini established through the plaintiff’s own deposition testimony facts that the court relied on in its motion, namely that the area was free of any hazards, and simply because the surface became wet when it rained could not serve as any basis to establish liability on the property owner.  SG was prepared for trial on this action, retaining a well-known neurosurgeon to testify on plaintiff’s surgical procedures, as well as vocational and economic damages experts.
