SG Obtains Dismissal of Child Victims Act Case
Plaintiff claimed that she was sexually abused by an employee while she was a resident of a group home in the 1970’s. Despite recent enactments of the Child Victims Act on timeliness, SG submitted a Motion to Dismiss in lieu of an Answer arguing that the action was barred by the Statute of Limitations. The Supreme Court, Westchester County agreed and dismissed the plaintiff’s complaint. Carolyn Loftus handled the matter on behalf of SG.
