Litigation arising from injuries to students, athletes and even spectators during sporting events has become a growing field in New York law. Our Firm focuses a substantial part of our practice defending against cases involving injuries to sporting participants and spectators of such events. We have represented municipalities and private schools, clubs and other businesses in sports related injury litigation. These institutions have ranged from colleges, private religious schools, after school programs, local, regional and nationally recognized sports clubs and community groups and organizations.
With our expertise in this field, we are able to evaluate a claim early, balance whether the injury was caused by a risk common to the specific sporting event or due to an increased risk created by negligence and then plot strategy accordingly. We have found innovative means to bring about favorable resolutions, even in the most difficult of cases. Our Firm was involved in an action defending a sporting club who was sued by a participant claiming a serious head injury. Her attorneys had initially demanded a $10,000,000 settlement. We were aggressive in the defense of the club and coach, hiring a well regarded medical expert who conducted several days of testing on the plaintiff. The expert was able to parse out the bolstered claims of the plaintiff's medical expert with real and objective neurological test results. Our Firm also commenced a motion on liability grounds which enabled us to resolve this very difficult case at only five figures, a fraction of what the Plaintiff was seeking.
