Summary Judgment to Daycare Center
On August 12, 2013, Schwab & Gasparini obtained summary judgment for its client, a local Westchester County daycare center. In Alfaro v. Harrison Children's Center, Inc., the Plaintiff claimed that a five year old child was injured due to the "negligent supervision" of daycare staff. However, discovery established that staff were present at the time of the incident, and the child's injury happened so suddenly, that as a matter of law "even the most intense supervision would not have prevented" the injury from occurring.
