Summary Judgment Awarded to Schwab & Gasparini Client in Head Injury Claim

In Naughton v. Rolling Hills Association Inc., et. al., the plaintiff had claimed she sustained  brain and neck injuries when she fell on a set of common area stairs at the defendant's apartment complex.  However, the Court noted that the plaintiff came forward with no proof that the defendant created any dangerous condition or had notice that it existed.  The Court also rejected an affidavit from the plaintiff herself which contradicted her prior deposition testimony, finding that the purported affidavit sought to "correct the very testimony which permitted defendants to" move for summary judgment.
